A university spokesman says 20-year-old Jason Johnson was asked to leave the small Baptist school earlier this week.

The student from Lexington was dismissed after he posted on his Web page at the popular Internet site MySpace.com that he was gay.

The university has a policy that says it reserves the right to expel a student who -- quote -- "promotes sexual behavior not consistent with Christian principles."

The university would not comment specifically on Johnson's expulsion, but school president Jim Taylor says in a statement that the school is unapologetic about its Christian beliefs.

private institutions have a right to expell students based on sexual orientation if it is founded in their charter.

I may be wrong on this, but I suppose they could theoretically at least based on federal law. Not sure exactly what state law says about the subject.

you can kick someone out of a public school for being gay. it has to be a private school that has it set up somewhere in their rules though. there's actually a vegan private non-religious college that can expell people if they are caught eating animal or animal by products. the thing that is going to make this case a big deal is the concept of state action, so they'll have to determine if the private institution is working as a state agent in any way.

Another important aspect of this case is that colleges are further trying to regulate off-campus activity in the virtual community. They are also saying that if its said on the internet, its true, which is going to be a bitch when they explain concepts of literary research and the internet.
