CO-BELLIGERENT- In this paragraph, the term `co-belligerent', with respect to the United States, means any State or armed force joining and directly engaged with the United States in hostilities or directly supporting hostilities against a common enemy. How you read over the words that stress the level of "supporting" is a wonder to me. Directly supporting a.k.a. giving support which DIRECTLY helps to engage in hostilities (attack) the U.S. ... the taliban qualifies under this as a state government which let Al'queda work unhindered and even used them as a tool within thier country. There is a difference between "supporting" attacks and "directly supporting hostilities" -------------------- |

Because im speaking logically and asking questions about whether something should or shouldn't be done... lol. The whole reason the MCA was controversial was because of the ambiguity. You could have given money to an organization or charity in Afghanistan. If that organization had ties to the Taliban...you're an unlawful combatant because you 'supported' the taliban. Yes, but it has to be determined how substantial your support of hostilities were. They have the commisions to determine how involved a person may have been and thats why we send some back, and for those we are unsure of, we hold them as enemy combatants and thus we don't risk sending an enemy back to the battlefield of a war (which we have also done). It is not a blanket statement war against all terrorism (as you have read in it). Maybe a little vague, but not so much as to think we are at war with all islamic terrorist groups... because we simply are NOT. We are at war with those who have comitted hostilities, or substantially helped those commit hostilities against the U.S. Im not arguing that the "War on Terror" is perfect (kind of fitting a square peg through the round hole), but it is a war against particular people (namely taliban, and al'qeda... though there have been some others). President declared it, Congress approved (via the statute), and supreme court has recognized it as a war. -------------------- |
