Does anything know anything about property lease laws?
My favorite bar/restaurant stays open till 2 am. Their dumbfuck landlord is now telling them they have to operate strictly as a restaurant and close at 10. I have no idea why, but I'm sure it has something to do with serving underage minors and the owner of the building being somehow liable if they get caught. There's no way in hell they can survive without creepy old drunks and college kids drinking till close. When a business signs a contract with a property owner, is there some stipulation in the contract that says when they can close? I'm hoping the lease can somehow be voided and they can move across the street. Otherwise, they're fucked -------------------- ![]() ![]() |

Pretty sure they're fucked. Well, fuck. Ok, next question. I know there are indemnity clauses that transfer legal liability from the landlord to the tenant if something goes wrong. Can this be done in a situation like this? -------------------- ![]() ![]() |

Will, I have two friends in law firms in Austin. E-mail me the details and I'll see what I can find.
There should be a clause in the lease stating what the business is running as (bar, restaurant, etc.). If it is not and there is no stipulation as to open/close time, then I think the guy should fight it. -------------------- "There is a level of cowardice lower than that of the conformist: that of the fashionable non-conformist." |

Oh, did the zoning in the area change by chance?
The landlord knew going into the contract that it would have bar hours, so that's in your favor -------------------- "There is a level of cowardice lower than that of the conformist: that of the fashionable non-conformist." |

They want out, the landlord wants em out, lease ends December 21st. Doubt I'll ever go back there anyway. -------------------- ![]() ![]() |
