according to the cop and his supervisor (my mom called the police station after the incident) it doesnt matter who started it. Because the child's mother reported it first and the child is under 10, my brother is automatically at fault.

thats what the station supervisor said... that if my brother had been arrested, the judge would most likely throw it out because of my brother's condition; however, she also wanted my mom to know that there are some judges that are not lenient at all with juvenile crime irregardless of mental disabilities.

Well as you described it, it wouldn't seem to be a crime irregardless of your brother's mental status. Since the young boy assaulted your brother first and your brother just stopped him (without even hurting him) and told him to leave, its not really a crime. And technically your brother could sue the kid for battery for hitting him.
