Once a design or drawing is created the owner has a protectible copyright of the design at the moment of creation, when the design is “fixed in a tangible medium of expression." IE, saved on a computer hard drive, which this obviously is. However, until you apply for copyright registration to the US Copyright Office for the player/dog logo, you have no legal recourse if someone else uses it. Only after you apply for a copyright can you seek statutory damages. Something tells me this kid didn't pay $45 and submit his design to the US Copyright office. Even if he did, he I doubt the case could be reviewed in time for him to get a copyright by this weekend. So, fuck him. He had his chance to make a bit of money off this, but he was a moron and didn't think his plan through. -------------------- |

he didnt have a plan... just wanted to piss off aggies and make a quick buck... i doubt he had any clue this would be all over the national news. i seriously doubt he went and looked up copyright laws before making the shirts.

Creative media is automatically copyrighted at the moment of creation. No registration with the US copyright office is required. The only point of copyright registration is to help prove who had the design first. Given the extensive media coverage this has gotten, I doubt that the kid would have any difficulty proving that his design predates yours.
You could probably get away with selling the shirts initially, but you'd still run the risk of being hit by a copyright infringement suit afterwards. What I wrote is what I gathered from reading some legalese about the subject. I suck at translating legalese into english. I have no problem giving him a cut of the proceeds. But if he ever wanted to come after me in court, I'd have a field day. Fraternities ALWAYS steal copyrighted logos to use for their frat party tshirts. His personal lawyers can go after me. McDonalds', Reeboks', Tides', etc lawyers can go after him and his fraternity. Something tells me they'd suffer a lot more than I will -------------------- |
