The defense's case won't hold up. Mailboxes aren't personal property after they're put up, so he wasn't really defending his property.

lawyer said you have every right to defend your property to prevent damage from occurring. NOT the right to strike out with acts of retribution. these guys were done, and walking away, and he smited them with his Homeowners Fury.

I guess you didn't read the article??? I addressed the defense's proposed defense.

Impala, but they didn't assault his property. Shouldn't matter if the mailbox happened to be on his property.

i'm just saying, just because the mailbox is technically the property of the government doesn't mean some jackholes can come onto your property and vandalize it while you watch.

Guess that also depends on the location of the mailbox whether it was even trespassing. I seem to recall the government owning a few feet perpendicular to the streets for some reason. Only way they could put a sidewalk there since they can't put them on private property or some such.

And does that mean you can go vigilante on someone that's vandalizing say a police car? a city hall? the state capital?

sure, if the police car, city hall, or state capital happens to be on your property wink.gif

but nah i mean it would be pretty situational as to whether or not you can swing for the fences at them with a baseball bat. if someone is on your property and refuses to leave, then yeah probably, but in this case the guy probably went over the top.

I think you're a bit off base with this comment. I think the actual mail boxes are property of the government, mainly to to make it illegal for people to deliver non metered (unpaid for) mail. The actual mailbox assembly - stone statue, for lack of a better term - is property of the homeowner. It's not like the government can come repossess it, as they can with trashcans.

The first three feet of your yard is technically property of the government - this allows them to put up road signs, sidewalks, etc without dumbasses suing them. So while the mailbox might not technically be on your property, the mailbox itself is still your property. So the statement "it wasn't OK for this guy to come after the kids because they weren't on his property" holds about as much water as saying "it's not OK to stop someone from vandalizing your car if it's parked on the street in front of your house," since the street is technically public property.

Dumbshits got what they deserved, regardless of how the court sees it.
