But that minor detail didn't stop Gokey, a Lodi city employee, from filing a $3,600 claim for the December accident, even after admitting the crash was his fault.

After the city denied that claim because Gokey was, in essence, suing himself, he and his wife, Rhonda, decided to file a new claim under her name.

City Attorney Steve Schwabauer said this one also lacks merit because Rhonda Gokey can't sue her own husband.

"You can sue your spouse for divorce, but you can't sue your spouse for negligence," Schwabauer said. "They're a married couple under California law. They're one entity. It's damage to community property."

But Rhonda Gokey insisted she has "the right to sue the city because a city's vehicle damaged my private vehicle."

In fact, her claim, currently pending at Lodi City Hall, is for an even larger amount — $4,800.

"I'm not as nice as my husband is," she said.

he may have not wrecked his truck on purpose, but it was his fault.



this kinda relates to the news story, but i don't know the official outcome. about a month ago, some guy who works at lubbock aero lost control of an airplane tug (they're pieces of shit, the accelerator always sticks, but they cost like $15k, so they never replace them) into a military trainer. i can't remember offhand what type of aircraft it was (wasn't a learjet), but they've got fiberglass antennae sticking out the back of the flaps, each about 6 inches long. so he loses control of this thing going backwards, and he runs one of the fiberglass things right into the middle of his back and breaks it off; the tug kept going, subsequently crashing into the flap, totally fucking it up. i had to go over there like 20 minutes after this happened to get some sectionals or something, and there was a bunch of blood on the ground and they were loading him into the ambulance. it was pretty funny, i think he got fired. my boss said it cost like $60,000 to fix the damn flap. don't know if he has to pay for it, but if i were him, i'd sue.
