I just got a phone call from cingular saying that my account will be terminated in 35 days because over 50% of my phone calls are off network. I have a nationwide, no roaming plan. I travel a lot, plus my hometown isn't on the cingular network. But since I had the nationwide no roaming I didn't think that would be a problem.

Now they are telling me they will terminate my contract AND I have to pay the early-termination fee.

Can they do this or am I getting screwed?

That's bizarre... I'd ask Gen, but I'm not at my home computer (and I don't know what her AIM name is off the top of my head)...

Read through your contract. If it's not in there, then I imagine they can't do that.

are you sure the phone call is from Cingular? cuz I like to play pranks on my roommate by sending her fake "sprint" text messages saying that she is over on her minutes and she needs to call and make a payment. I would call cingular and ask them to verify that they called you.

i dont see why they would straight up tell you that they are terminating your contract. they should just say that you owe a bunch of money. I would ask to talk to a supervisor if the person you are talking to now doesnt fix the problem.

That's the thing, I don't owe them any money. They are saying that because I make off-network calls that its costing them a lot of money, so they're terminating my contract.

Which I think is complete bullshit

Talk to a supervisor. If he/she doesn't resolve the issue, talk to his/her supervisor... and so on. It's bullshit. Unless you're violating your contract, they shouldn't be able to terminate it, much less force you to pay the early cancellation fee.

I think it's in your contract, actually. They can also terminate your service if you don't use a percentage of your minutes each month, which I think is just dumb, but they haven't terminated me yet.

If they terminate your contract you dont have to pay a fee...but if you were to terminate there would be a fee; they prolly hope you dont read the fine print.
