Yes, but that's the problem. There doesn't have to be strong evidence. All the president has to do is label someone an "enemy combatant" and then he can lock them away for life without a shred of evidence.

Even if you trust Pres Bush to do this, how can you trust any future presidents who may or may not be quite so nice? And more importantly, even if you trust President Bush, how can you trust every single person who's in a position to make decisions on this?

EDIT: Secondly, the Constitution limits a legal immigrant's right to vote. It doesn't apply such limits on habeas corpus.
