Jefferson was largely against Judicial Review:
QUOTE
"The question whether the judges are invested with exclusive authority to decide on the constitutionality of a law has been heretofore a subject of consideration with me in the exercise of official duties. Certainly there is not a word in the Constitution which has given that power to them more than to the Executive or Legislative branches." --Thomas Jefferson to W. H. Torrance, 1815. ME 14:303

-time has shown judicial review to be a very good system. However, allowing those in legislature and executive to decide whether they are being constitutional (as jefferson wanted), and then relying on the VERY slow process representation reinforcement was just a system that gave WAY too much power to the legislature (since the constitution gives them the power to make law and the fact that voting to oust people who are violating rights is just too slow).
-Not to mention that checks and balances were included WITH seperation of powers.

Jefferson was in favor of limited tenure for judges, and only reappointment for APPROVED decisions.
QUOTE
"It has been thought that the people are not competent electors of judges learned in the law. But I do not know that this is true, and, if doubtful, we should follow principle. In this, as in many other elections, they would be guided by reputation, which would not err oftener, perhaps, than the present mode of appointment." --Thomas Jefferson to Samuel Kercheval, 1816. ME 15:36

"Render the judiciary respectable by every means possible, to wit, firm tenure in office, competent salaries and reduction of their numbers." --Thomas Jefferson to Archibald Stuart, 1791. ME 8:277
Despite his reasoning it has MANY flaws. Like the fact that constant appointments based on APPROVED decisions is a matter of POLITICS for how judges decide cases (instead of using legal reason, precidence, and the constitution). Not to mention the fact that censorable (wrong) decisions by judges CAN be remedied in our current system through impeachment.

And in regards to shay's rebellion and the failed attack on a federal arsenal to create A CIVIL WAR jefferson wrote (from the safety of europe):
QUOTE
"A little rebellion now and then is a good thing. It is a medicine necessary for the sound health of government. God forbid that we should ever be twenty years without such a rebellion."

My whole point is that Jefferson is a great founding father, but on a completely different spectrum of what he considers a well run government. It seems that he almost feared loss of freedom SO MUCH that he believe we need an almost constant revolution to keep the government honest.

Personally i am more of a fan of the Federalist Papers (especially Madison's) in regards to believing that a successful government could be created that DOES IN FACT protect the intrests of the people (and insure freedom with checks and balances as well as seperation of powers)
