Unfortunately the article disappeared, but it is still cached on google.
Bush submits new terror detainee bill
QUOTE
U.S. citizens suspected of terror ties might be detained indefinitely and barred from access to civilian courts under legislation proposed by the Bush administration, say legal experts reviewing an early version of the bill.

A 32-page draft measure is intended to authorize the Pentagon's tribunal system, established shortly after the 2001 terrorist attacks to detain and prosecute detainees captured in the war on terror. The tribunal system was thrown out last month by the Supreme Court.

Administration officials, who declined to comment on the draft, said the proposal was still under discussion and no final decisions had been made.

Senior officials are expected to discuss a final proposal before the Senate Armed Services Committee next Wednesday.

According to the draft, the military would be allowed to detain all "enemy combatants" until hostilities cease. The bill defines enemy combatants as anyone "engaged in hostilities against the United States or its coalition partners who has committed an act that violates the law of war and this statute."

Legal experts said Friday that such language is dangerously broad and could authorize the military to detain indefinitely U.S. citizens who had only tenuous ties to terror networks like al Qaeda.

"That's the big question ... the definition of who can be detained," said Martin Lederman, a law professor at Georgetown University who posted a copy of the bill to a Web blog.

Scott L. Silliman, a retired Air Force Judge Advocate, said the broad definition of enemy combatants is alarming because a U.S. citizen loosely suspected of terror ties would lose access to a civilian court — and all the rights that come with it. Administration officials have said they want to establish a secret court to try enemy combatants that factor in realities of the battlefield and would protect classified information.

The administration's proposal, as considered at one point during discussions, would toss out several legal rights common in civilian and military courts, including barring hearsay evidence, guaranteeing "speedy trials" and granting a defendant access to evidence. The proposal also would allow defendants to be barred from their own trial and likely allow the submission of coerced testimony.

Senior Republican lawmakers have said they were briefed on the general discussions and have some concerns but are awaiting a final proposal before commenting on specifics.

Attorney General Alberto Gonzales and Deputy Defense Secretary Gordon England are expected to discuss the proposal in an open hearing next Wednesday before the Senate Armed Services Committee. Military lawyers also are scheduled to testify Wednesday before the Senate Judiciary Committee.

The legislation is the administration's response to a June 29 Supreme Court decision, which concluded the Pentagon could not prosecute military detainees using secret tribunals established soon after the Sept. 11, 2001, terrorist attacks. The court ruled the tribunals were not authorized by law and violated treaty obligations under the Geneva Conventions, which established many international laws for warfare.

The landmark court decision countered long-held assertions by the Bush administration that the president did not need permission from Congress to prosecute "enemy combatants" captured in the war on terror and that al Qaeda members were not subject to Geneva Convention protections because of their unconventional status.

"In a time of ongoing armed conflict, it is neither practicable nor appropriate for enemy combatants like al Qaeda terrorists to be tried like American citizens in federal courts or courts-martial," the proposal states.

The draft proposal contends that an existing law — passed by the Senate last year after exhaustive negotiations between the White House and Sen. John McCain (news, bio, voting record), R-Ariz. — that bans cruel, inhuman or degrading treatment should "fully satisfy" the nation's obligations under the Geneva Conventions.

Sen. John W. Warner (news, bio, voting record), R-Va., chairman of the Armed Services Committee, said Friday he expects to take up the detainee legislation in September.

Probably like other draconian acts that have been passed, it will fly through and get passed without any changes, or anyone reading it.

But, national security, wah.

Wait, this should never work because it's unconstitutional. It's one of the biggest things in the Bill of Rights, as well...

Obviously this is a violation of the 6th Ammendment and, depending on the interpretation of "hostilities against the US", could violate the 1st Ammendment as well.

There is a difference between a black person and a nigger.
There is a difference between a Arab and a towel head or sand nigger, if you will.

It makes me laugh when people say that. Its just to justify them saying a racist remark. I, on the other hand, am not a racist. I dont like Muslims, but I do like Arabs. I just like the word towel head. It makes me giggle. Then again so does honkey and cracker.

Anyways, Im not white trash. White trash live in trailer parks, wear wife beaters, and talk about "linching niggers" of which I do not do. I dont like the Muslim religion one bit.

Based off of the above post...

WHITE TRASH COMMENT STANDS.

Your blanket hatred for Muslims is absolutely idiotic and backwards. I'm assuming you just hate Muslims (BTW: Islam is the religion, not "Muslim"...) because of 9/11?

Because all Muslims are bred to hate America. It says so in the Koran, I read it.

No, I stood up for Muslims for quite a long time after 9/11. About ooooooo a year and a half ago, I read some interesting information from a reliable source and have studied the Koran. It really is a very violent religion, and unlike Christianity, it doesnt have a New Testament. The New Testament pretty much shows that Christianity is a peaceful religion. The Old Testament, yeah I'll give in that its violent. I like all sorts of religions and philosphies: Buddhism, Hinduism, etc etc but Im sorry I dont like the Muslim religion. I dont like Bush either. Does that make me hippy white trash? Yes, I made a blanket generalization. Obviously there are exceptions to the rule, like Lauryn Hill for instance. I like her and I think she is Muslim. In all seriousness though, of course there are nice people out there who practice te Muslim religion, but generally its a very hateful religion.

The New Testatment shows Christianity as peaceful, yes. But what do CHRISTIAN's show of Christianity? I mean, we can't forget about forcing their beliefs on others, the Crusades, and God's War on Terror (oops, I mean Bush's War on Terror).

Blanket statements are FUN!

And it's all about interpretation when it comes to religion and how it is practiced.

I will give you that, but there are countries over there that breed their kids to all practice the same way. Unlike most, I dont have a problem with Lebanon nor her people. Most of her citizens are good, law abiding citizens. Its that damn Hezbollah. I do have a problem with countries like Iran though. Do note that a large portion of Lebanon's people are Christian and not Muslim.

I know many areas in America that breed their children to be just as intolerant as those in the majority of Iran and other such 'indoctrinated' regions of the world.

See: Deep south, areas of the midwest, yadda yadda

Then your problem shouldn't be with Islam at all but with parents forcing children to practice something corrupt (ie, teaching kids to be racist or what have you).

I doubt the bill is for "U.S. citizens" as it would be a major transgression against our Bill of Rights. I see this being more for those that are already in custody who certainly aren't citizens and who certainly don't deserve the rights granted by our Constitution.

That's what I find funny about all of this. Muhammed Jalad Balakadar is arrested in Afghanistan because he's planting C4 under the hood of a convoy truck and imprisoned at a U.S. facility. Then everyone cries about them being abused and how their rights are being violated when they don't even have rights in their own country.

Stop trying to make the world huggie bear land and realize there are people out to fuck us. Not because Bush is stirring the damn hornet's nest but because we are "evil". Infidels to be erased from this world.

WHY?! FOR THE LOVE OF ALL THINGS GOOD...would you want to protect them. These guys aren't going to love you more because you set them free. They'll turn right around and shoot you in the fucking back because THAT'S WHAT THEY DO.

Stop whining. The authorities aren't out there arresting Mary Rubelstien because her homemade apple pie looked like a bomb. They're protecting your ass from Derkasherpamubad walking into your coffee shop and pushing the OH NOES button.

Personally though, I don't think the "terrorists don't deserve this" argument holds a lot of water. The point of a trial is to determine if they REALLY ARE terrorists. If they are, fine do whatever's neccessary. If they aren't, well, then I guess they do deserve a trial, don't they?

Your blanket hatred for Muslims is absolutely idiotic and backwards. I'm assuming you just hate Muslims (BTW: Islam is the religion, not "Muslim"...) because of 9/11?

i'm pretty sure you've said something similar about Christianity and/or Christians.

i'm assuming it's because of all the crusades and hypocrites?

You mean that's wrong?

Personally though, I don't think the "terrorists don't deserve this" argument holds a lot of water. The point of a trial is to determine if they REALLY ARE terrorists. If they are, fine do whatever's neccessary. If they aren't, well, then I guess they do deserve a trial, don't they?

the point is that they'll be tried in a military court instead of a public court...

because in a public court...there's always the chance they get off scott free

Thats every hippy's excuse...THOSE NASTY CHRISTIANS DID IT 500 YEARS AGO SO THEY ARENT ANY BETTER. Guess what? Muslims have been acting like this since before the Crusades...and today they STILL are at it. Hmmm makes you think

islam is the second largest religion - fanatics are very few in number considering the size, just like christianity

whats your feelings on nazis? i mean they were killing jews left and right althought it was 70 some odd years ago.
they may feel the same but only a certain few do anything about it anymore

christians killed people left and right 500 some odd years ago (the crusades is not the last time major killing and massacres happened in the name of their god - hello discovery of the new world and "converting" native people)
sure we arent lopping off peoples heads off or castrating them anymore but there are some that still feel that way (fanatical christian groups)

and no muslims havent been "acting this way" for thousands of years

When they can pretty much make their own army with ONE fanaticalist group, yeah thats not so small in number anymore.

Nazis STILL want Jews and other minorities done away with. Yeah, there are still people that consider themselves to be Nazis. That argument goes out the window.

Christianity as a whole was very dark for about 600 years which includes the Crusades and the conquering of native people here in america. How long has the Muslim religion been like that? Since around the 8th or 9th century. Remember how the Moors (Muslims) conquered Spain.

what....
christian rome persecuted pagans, jews etc etc
so you are saying christianity has been equally as violent as the other major religion

yes

you used it in a context as to argue that it happened 70 years ago so its not going on anymore in an attempt to devalidate what Impala said.

Its still going on today. Christian persecution towards Jews on the other hand is not. Thanks for playing

You're so cute when you present an e-attitude! Keep it up and maybe you'll move out of the apathetic zone so common to our generation. laugh.gif

I love how you and impala completely twisted what I said. Remember how I said "out of jest or brief anger (brief as in my feelings were temporary and are not a reflection of my true attitudes)" when referring to 'blanket Christian bashing'? Nope? Ok, re-read please.

Did I say that because of the Crusades and certain fanatical groups that suddenly ALL Christians are bad? Nope.
Osama Bin Laden gives a bad name to Islam just as Pat Robertson gives a bad name to Christianity. Unfortunately, these two get a lot of air-time in their respective regions. And in the opposite region, they are believed to be the norm (in many instances).

I'm not quicker to take any one person or group's side or an issue. I look at both sides of an arguement and make a judgement based off of what information/proof/evidence I have before me. Try it sometime, it's a cool way to logically discuss an issue (addressed to both Jessica and Impala).

Play nice, kids.

Psykopath I have no ill feelings towards muslims at all. I know that it's a select group of radicals causing all the problems. It's the position I've always held. And I called you out on your "crusades didn't help Christianity" because it was a stupid comment that's not related to Christians today.

And the comparison to the Nazi regime doesn't make much sense either as it's not really a religion, and I'm not sure any good could ever come out of being a Nazi.

People are not terrorists because of religion. They're terrorists because they hate us and want to inflict pain and suffering on us (Americans). Some of them may use their religion as an excuse, but it simply boils down to hate. There are tons of other countries that are primarily Christian, why haven't they been attacked? The last major terror attacks have been on England (who has been our biggest ally) and us. They're attacking the United States, not Christianity. They hate us because they're on top. Just like it's easy to hate the number one team when it aint yours.

oh yeah and call me a kid all ya want... you were in jr high when i was in college

no one can deny that christianity THROUGH THE ENTIRE HISTORY has been filled full of blood shed fairly consistantly.

and i don't know about you, but i find that if i'm in the mood to find the most intolerant and closed minded people in large groups, i can head to a local christian church of almost any creed.

so, there is some truth. sure, it may not compare to christians NOW, but with their history, what about tommorow? a month from now? years? like an ex convict who's been locked up 4 different times, i'm not gonna trust him very much.
