Doesn't matter. If you are in the hands of a police officer and forcibly remove the hands (as did this guy) it's resisting or assault, depending on how nice the cop is.

How did he not resist? After the dude had to practically pick him up and carry him to the back of the auditorium he gets lose and tries to run back towards back past them at which point they take him to the ground.

yea. i bonded out a guy yesterday for "assault on a public servant"

the guy was being cuffed and accidently stepped on the cops foot.

its bullshit, but the cops can do it

From the Daily Kos article. When he starts yelling, the police remove him. Kerry says "I'll answer his question". Apparently someone was telling the cops to remove this guy because they don't just start throwing people out for no reason.

In your video, he starts pulling away from the cops even with his "hands in the air". He can try to play the innocent, look at me, police brutality card all he wants but if he had just gone along with it they probably would have led him outside, let him go and his video still would have been all over the internet. Instead he just looks like an idiot.

I guess he could consider himself lucky that he doesn't live somewhere like Germany where they'll just tear gas your ass, no questions asked.

the fact is...that I think some are overlooking...not whether the kid had the RIGHT to speak, whether or not Kerry was going to answer his question, whether or not the cops were overstepping their bounds, whether or not condoleeza is a dyke...none of that matters.

all that matters is, the cops were trying to subdue/escort the kid and he put up a fight. that is an automatic beatdown in cop terms. period.

It doesn't matter. He was asked to stop. He didn't.

This isn't a free speech issue. He cut, was asked to leave, he got cut off. Who cares if Kerry was going to answer the question. The way the guy was talking, he was going to keep asking questions. He asked about 4 in 15 seconds, then lashes out at Kerry.

But again, that isn't the issue. The issue is that the cops escorted him out and he resisted.

Oh, and to answer a question posed previously, I'm not going anywhere if a cop doesn't tell me why I'm being arrested, what the charge is, etc.

Years back my friend got pulled over. Cop refused to tell him why he was being pulled over, even though he wasn't speeding nor breaking any traffic laws. My friend, in a mature manner, stated he was not showing the cop any insurance or form of identification until he was told what the charge was. Cop pulled his gun on him, arrested him, and searched his car without a warrant.

After my friend hired a lawyer and he actually fought it, all charges were dropped and the cop was suspended for two weeks with pay.
